Both Target and Big W have been reprimanded for failing to accept returns on faulty appliances and gaming consoles.

In two statements today, the Australian Competition and Consumer Commission (ACCC) said it will be entering two enforcable undertakings with the Woolworths-owned Big W and Wesfarmers-owned Target.

Both retailers have previous admitted they ‘may have breached’ Australian consumer law after refusing to accept returns for goods through their stores and instead passing the responsbility to the manufacterers.

Big W has been targeted over its policy over faulty Dyson appliances it sold between December 2016 and April 2018.

Target has been looked at over their failure to accept returns on faulty Sony Playstations it sold between January and August 2017.

“Consumers have a right to ask the business they have purchased a faulty product from for a repair, replacement or even a refund, depending on the seriousness of the fault, ACCC commissioner Sarah Court said of both cases.

The ACCC says staff at the retailers told customers they were not eligible for returns due to the complaints being made two weeks to one month after purchase.


“A retailer cannot simply send a consumer to the manufacturer and wash their hands of any responsibility,” Ms Court said.

“Consumer guarantee rights cannot be excluded or modified by businesses and retailers cannot set an arbitrary time limit on their obligations under the consumer guarantees.”

In a statement, Big W said “We have cooperated with the ACCC and are committed to implementing a number of additional compliance measures, as set out in the undertaking, to ensure that we’re taking a customer-first approach to handling faulty product returns.”
